Visitor conditions

Introduction

Stichting Stedelijk Museum Alkmaar will do everything possible, within reason, to ensure that a visit to the museum complex and the exhibitions and activities organized by the museum management take place in accordance with the visitor's wishes. Stedelijk Museum Alkmaar will make every effort to minimize any nuisance or inconvenience to the visitor, as well as to ensure the safety of the visitor as much as possible.

General provisions: definitions

Article 1.1
By "the museum" and Stedelijk Museum Alkmaar (hereinafter referred to in the text as "the museum") is meant the organization that manages and operates the museum complex, including, but not limited to, the management, public employees and other museum officials authorized to act on behalf of this organization.

Article 1.2
'The museum complex' means the entirety of spaces (built-up and unbuilt) that fall under the legal or management authority of the management of the Stichting Stedelijk Museum Alkmaar, including, but not limited to, exhibition halls, foyer, Cultuurcafé, museum store, museum workshop, offices, depot and annexes.

Article 1.3
By `visitor' is meant any person who in any way, whether or not (in)directly enters into an agreement with the museum for the purpose of entering the museum complex and/or visiting an exhibition or attending an activity organized by the museum for the regular visitor during regular opening hours.

Article 1.4
These General Conditions for Visitors apply to any agreement between the museum and a visitor. The conditions do not apply to special activities outside regular opening hours and/or aimed at other than the regular visitor, as in the case of hall rental, catering and the like.


Ticket sales, offers and prices

Article 2.1
All quotations, communications or information otherwise provided by the museum are not without obligation (subject to typographical errors). The museum accepts liability for any errors made by the museum itself in quotations, announcements or otherwise provided to the visitor. This liability applies only to the museum's own information material present within the museum at the time of the claim, or recently distributed by or on behalf of the museum. The museum is not liable for errors due to intent, fault or negligence of third parties.

Article 2.2
The visitor shall at all times be required to present the admission ticket and any card or voucher entitling him/her to a discount on the admission price to officials recognizable as such, including but not limited to attendants.

Article 2.3
The potential visitor is not entitled to obtain a refund of the admission price or any other compensation in case of loss or theft of the admission ticket before entering the museum complex. If a potential visitor does not use the pre-purchased admission ticket, this is at the visitor's own expense and risk; this is also the case if the admission ticket is only valid for a specific time and/or date. An admission ticket once obtained can be rescheduled up to one day in advance (provided it fits within the dates offered in the ticket module and equal conditions) to another date via a link in the confirmation email. There will be no refund of the admission price. However, the price of admission paid may be refunded if circumstances beyond the buyer's control make it impossible to visit the museum, at the management's discretion.

Article 2.4
The potential visitor may be denied entry to the museum complex if it appears that the admission ticket, discount card or voucher has not been obtained from the museum or a body authorized by the museum.

Article 2.5
The museum will refund the entrance fee actually paid by the visitor only if the visitor has to leave the museum complex prematurely due to an unannounced exercise as part of the company emergency response (Article 23 of the Occupational Health and Safety Act), as well as in the event of an actual calamity that results in the museum complex being evacuated in whole or in part.

Stay in the museum complex

Article 3.1
During their stay in the museum complex, visitors shall behave in accordance with public order, good morals and the rules of decency applicable to the nature of the activity visited. The visitor is also obliged to immediately follow the directions and instructions given by identifiable museum officials, including but not limited to attendants.
If in the reasonable judgment of a duly authorized official of the museum, who must be recognizable as such, the visitor violates these standards, directions or instructions in any way, the visitor may be denied further access to the museum complex, without the visitor having any right to reimbursement of the cost of the admission ticket or any other expenses incurred.

Article 3.2
Parents or supervisors of children are at all times responsible for and accountable for the behavior of children they bring with them. Teachers and supervisors of groups are responsible for and accountable for the behavior of group members they supervise. Children under the age of 12 must be accompanied within the museum complex by an adult.

Article 3.3

Among other things, visitors are prohibited from entering the museum complex:

  1. offer goods of any kind for sale to third parties, or provide them free of charge;
  2. intentionally and prolongedly obstruct other visitors' way or obstruct the view of exhibits;
  3. disturb other visitors, including, but not limited to, by the use of cell phones, Ipods, MP3 players or other sources of noise pollution; however, the use of such equipment may be expressly permitted by the Museum in certain areas;
  4. bring (domestic) animals, unless they are (guide) dogs and accompany a visitor with an identification card;
  5. to smoke in all enclosed areas of the museum complex;
  6. bring food and beverages into the enclosed areas of the museum complex;
  7. bring flowers, plants or other living organisms into the enclosed areas of the museum complex;
  8. in the opinion of an officer of the museum recognizable as such, to carry dangerous objects or substances, including, but not limited to, walking sticks, umbrellas or large bags; these may be dropped off at a place to be designated by the museum;
  9. touching exhibited objects and exhibition materials such as display cases, lighting, partitions and the like, unless expressly and explicitly permitted. Parents or supervisors of children should strictly ensure that exhibited objects are not touched by the children they bring with them. Small children should be held by hand or transported by baby carriage; similarly, teachers and supervisors of groups shall ensure that the group members they are accompanying do not touch the exhibits.

Article 3.4
In special cases where the general safety of persons or the collection reasonably requires it, a senior museum official, who must be recognizable as such, may request inspection of the (hand) luggage carried by the visitor. Furthermore, if deemed necessary, specially trained and educated personnel may request the visitor to cooperate in a security search upon entering or leaving the museum complex. The potential visitor will be warned before entering the museum complex that this measure is in effect.

Article 3.5
Other than with the prior written consent of the museum's management, visitors are prohibited from making photographic, video and film recordings using lamps, flash equipment and tripods. Furthermore, other than with the prior written consent of the museum's management, it is prohibited to use any photographic, video and film recordings for commercial purposes in any manner and medium whatsoever, including electronic media.

Article 3.6
The museum may deny access to the museum complex permanently or for a certain period of time to a visitor who, during one or more previous visits to a Dutch museum complex, has deliberately damaged an object, or who otherwise justifies the fear of damage; the museum may in any case subject this visitor to the measures mentioned in Article 3.4 of these Conditions for Visitors during all his visits. The decision to deny access must be notified to this visitor without delay and with reasons, if possible in writing.


Complaints and claims

Article 4.1
The museum will do everything possible to ensure that visits to the museum complex or exhibitions and activities organized by the museum are in accordance with the published offer; this includes the obligation to inform the public to the best of its ability about full, partial or early closure of the museum complex and/or exhibitions organized by the museum. Furthermore, the museum informs the potential public about maintenance work, renovations or the (re)arrangement of spaces causing nuisance. The visitor can never derive a right to compensation from this.

Article 4.2
Advertising is not possible with respect to the following complaints and circumstances, which cannot be avoided by the museum, and therefore never lead to any obligation for compensation by the museum to the visitor:

  1. complaints relating to the invisibility of objects from the museum's permanent collection;
  2. complaints relating to the partial closure of the museum complex, including, but not limited to, partial closure due to exhibition construction or dismantling;
  3. complaints and circumstances relating to nuisance or inconvenience caused by other visitors, including but not limited to noise, inappropriate behavior, theft and molestation;
  4. complaints and circumstances relating to nuisance or inconvenience caused by maintenance work, including, but not limited to, remodeling or the (re)furnishing of rooms;
  5. complaints and circumstances involving nuisance or inconvenience caused by the improper functioning of facilities in the museum complex.

Article 4.3
Complaints and requests for recovery regarding the agreement between the museum and the visitor must reach the museum in writing within six weeks after the visit has taken place. Complaints and requests for recovery submitted after this deadline will not be considered. A complaint form is available with these Conditions of Visit.

Article 4.4
The museum will investigate the complaint and respond in writing within 30 days of receipt. If the investigation is not completed by then, the complainant will be notified of this and the probable time when it will be.

Article 4.5
Visitors may submit complaints, complaints and suggestions for improvement in writing or by e-mail by completing a form available with these Conditions of Visit.


Liability of the museum

Article 5.1
The museum is never liable for damage resulting from quotations, announcements or other forms of information provided by the museum and/or third parties to the visitor, except if and insofar as this damage is the direct result of intent or gross negligence on the part of the museum and/or its employees.

Article 5.2
Visitors' stay in the museum complex is at their own expense and risk.
The museum is only liable for property and/or consequential damage suffered by the visitor or injury inflicted on the visitor that is the direct and exclusive result of intent or gross negligence on the part of the museum, on the understanding that only that damage is eligible for compensation for which the museum is insured, or should have been insured in all reasonableness and fairness.

Article 5.3
In no case shall the museum be liable to pay an amount of compensation greater than:

  1. The actual admission price paid and actual travel expenses incurred or, if more;
  2. The amount paid by the insurer of the Stichting Stedelijk Museum Alkmaar to the Stichting Stedelijk Museum Alkmaar in respect of the damage, or;
  3. the compensation obtained in respect of the damage from another third party.

Article 5.4
The museum is never liable for damage caused to the visitor's vehicles except if and insofar as the damage is caused on or in the museum premises and this damage is the direct result of intent or gross negligence on the part of the museum and/or its employees.

Article 5.5
The museum is never liable for any (in)direct damage whatsoever, incurred as a (in)direct result of any defect, any quality or circumstance on, in or on any immovable property of which the museum is the holder, leaseholder, lessee or owner or which is otherwise at the disposal of the museum, except if and insofar as the damage is the direct result of intent or gross negligence on the part of the museum and/or its employees.

Article 5.6
If the museum accepts goods or if goods are deposited, kept and/or left anywhere by anyone in any way without the museum stipulating any compensation, the museum shall never be liable for damage to or in connection with goods in any way unless the museum has intentionally caused damage, or the damage is the result of gross negligence on the part of the museum.

Article 5.7
The museum's total liability for attributable failure to fulfill the visit agreement shall be limited to compensation for direct damage and shall in no case exceed the compensation arrangement described under 5.3.

Article 5.8
In the event of damage due to death or bodily injury, the Museum's total liability will in no case exceed the compensation arrangement described under 5.3.

Article 5.9
Liability of the museum for indirect damages, including consequential damages, lost profits or wages, missed savings et cetera, is excluded.

Article 5.10
The maximum amounts mentioned in Article 5.3 shall cease to apply if and insofar as the damage is the result of intentional or gross negligence on the part of the Museum or any of its officers.


Force majeure

Article 6.1
As force majeure for the museum, which means that any shortcoming caused by it cannot be attributed to the museum, is considered any unforeseeable circumstance that interferes with the execution of the agreement by the museum to such an extent that, temporarily or permanently, the execution of the agreement becomes impossible or difficult.

Article 6.2
Such circumstances shall include circumstances involving persons and/or services and/or institutions used by the museum in the execution of the visit agreement, as well as everything that applies to the aforementioned as force majeure or suspensive or resolutive condition, as well as attributable failure on the part of the aforementioned.


Found objects

Article 7.1
Items found by visitors in the museum complex can be dropped off at the museum's front desk.

Article 7.2
The museum will make every effort to locate the owner or rightful claimant of the found object and will maintain regular contact with the local police for this purpose. Found objects of which, after three months in the museum's custody, no delivery has been requested by the owner or rightful claimant will be handed over to the local police.

Article 7.3
In case the owner or rightful claimant of a found object comes forward, he/she has the choice of collecting the goods himself/herself or having them sent to him/her cash on delivery. In both cases the owner or entitled party must provide proper identification.

Other conditions

Article 8.1
The applicability of these Conditions for Visitors does not affect the possible applicability of other (contractual) conditions and/or regulations of the Museum.


Applicable law

Article 9.1
These Conditions for Visitors and the agreement between the visitor and the museum are governed by Dutch law.

Article 9.2
All disputes arising from the agreement between the visitor and the museum shall be submitted exclusively to the court having jurisdiction in Alkmaar.

These Visitor Terms and Conditions of Stedelijk Museum Alkmaar were adopted by the director and filed with the Chamber of Commerce on August 4, 2014 under number 59292938.
